Terms of Service

Please read these Terms of Service ("Terms") carefully before using Calm Public Tantrums (the "Service," "we," "us," or "our"). By accessing or using our digital product, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, clicking "I Agree," downloading, installing, or otherwise using the Service, you represent that:

You are at least 18 years of age (or the age of majority in your jurisdiction).
You have read, understood, and agree to be bound by these Terms.
If you are accepting on behalf of an organization, you have the authority to bind that entity to these Terms.

2. Description of the Service

Calm Public Tantrums is a digital software product that helps parents handle toddler tantrums in public settings using the C.A.L.M. method. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Registration

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or for any other reason we deem appropriate.

4. Permitted Use and Restrictions

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Use the Service in any way that violates applicable law or regulation.
Reverse engineer, decompile, or disassemble any portion of the Service.
Copy, reproduce, distribute, or create derivative works from the Service without our express written permission.
Use automated scripts, bots, or other means to access the Service without authorization.
Attempt to gain unauthorized access to any systems or networks connected to the Service.
Upload or transmit defamatory, obscene, abusive, or otherwise objectionable content.
Use the Service to send unsolicited communications (spam).
Impersonate any person or entity or falsely state your affiliation with any person or entity.

5. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, software code, and design — are the exclusive property of Calm Public Tantrums and are protected by applicable copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes only.

6. User-Generated Content

If the Service allows you to submit, post, or share content ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation of the Service.

7. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge and agree to the collection, use, and sharing of your information as described in our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALM PUBLIC TANTRUMS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Calm Public Tantrums and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Service, your User Content, or your violation of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which Calm Public Tantrums operates, without regard to its conflict of law provisions. Any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class action.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending an email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Provisions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Third-Party Links and Services

The Service may contain links to third-party websites or integrate with third-party services. We have no control over the content, privacy policies, or practices of such third-party sites and assume no responsibility for them.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Calm Public Tantrums with respect to the Service and supersede all prior agreements, understandings, and representations.
